These Terms of Service ("Terms") govern your access to and use of the Takamul platform, websites, dashboards, APIs and related services (together, the "Services") operated by Takamul. By creating an account, opening a store, or otherwise using the Services, you agree to be bound by these Terms.
1. Acceptance of these Terms
By accessing or using the Services you confirm that you are at least 18 years old, legally able to enter into a binding contract, and authorised to act for any business you represent. If you do not agree with any part of these Terms, you must not use the Services.
- You accept these Terms on behalf of yourself and the merchant entity you register.
- Additional product-specific terms or order forms may apply and form part of this agreement.
- We may update these Terms from time to time; continued use after changes means you accept the updated version.
2. Your account
You are responsible for the information you provide and for all activity that happens under your account. Keep your credentials confidential and notify us immediately of any unauthorised access.
- Provide accurate, current and complete registration details, including a valid +966 contact number where applicable.
- You are responsible for the acts of staff and collaborators you invite to your store.
- We may suspend or close accounts that contain false information or that breach these Terms.
3. Plans, billing and VAT
Paid plans are billed in advance on a monthly or annual basis in Saudi Riyals (SAR). All fees are exclusive of value added tax (VAT), which is currently charged at 15% in the Kingdom of Saudi Arabia and added to your invoice where required by law.
- Subscription fees renew automatically until you cancel from your dashboard.
- A compliant tax invoice including the applicable 15% VAT is issued for each payment.
- Transaction, gateway, and third-party app fees may apply in addition to your plan fee.
4. Acceptable use
You agree to use the Services lawfully and not to sell prohibited goods or misuse the platform. We may review stores to protect buyers, merchants and the integrity of the platform.
- No goods or content that are illegal under the laws and regulations of Saudi Arabia.
- No fraud, deceptive pricing, counterfeit products, or infringement of intellectual property.
- No attempt to disrupt, reverse engineer, overload or gain unauthorised access to the Services.
- No use of the Services to send unsolicited messages or to violate buyers' privacy.
5. Your store content
You retain ownership of the products, text, images and other materials you upload ("Merchant Content"). You grant us a limited licence to host, display and process that content solely to provide the Services.
- You are responsible for the legality and accuracy of your Merchant Content.
- You confirm you hold all rights needed to publish the content you upload.
- We may remove content that breaches these Terms or applicable law.
6. Our intellectual property
The Takamul platform, brand, software, designs and documentation are owned by Takamul or its licensors and are protected by law. Except for the rights expressly granted to you, no licence is transferred to you.
7. Suspension and termination
You may cancel your subscription at any time. We may suspend or terminate access where you breach these Terms, fail to pay, or where required to protect the platform or comply with the law. On termination your right to use the Services ends, though certain provisions survive.
8. Disclaimers and limitation of liability
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Takamul is not liable for indirect or consequential losses, and our total liability for any claim is limited to the fees you paid for the Services in the twelve months before the event giving rise to the claim.
9. Governing law and disputes
These Terms are governed by the laws and regulations of the Kingdom of Saudi Arabia. Any dispute that cannot be resolved amicably shall be referred to the competent courts in Riyadh, Saudi Arabia.
10. Changes to these Terms
We may revise these Terms to reflect changes in our Services or the law. Where changes are material we will give reasonable notice. The "last updated" date above shows when this version took effect.
